Terms for Affiliates on Gambling Marketing and Advertising in the UK

1. Introduction

1.1. These are the Market-Specific Terms published by Us in respect of the UK for the purposes of clause 1.3 of the LeoVegas Affiliate Partner Terms and Conditions (the “Terms and Conditions”), and are referred to in this document as the “UK Terms”. Together with the Terms and Conditions, the UK Terms form a separate agreement for the UK market, in accordance with clause 1.3 of the Terms and Conditions, between GameTech Marketing Limited, a LeoVegas Mobile Gaming Group company, and You acting as an Affiliate.

1.2. These UK Terms and any amendment to them, shall come into effect and become binding on You in accordance with clause 1.3.3 of the Terms and Conditions, including upon publication on https://www.leovegasaffiliates.com/terms-and-conditions, or any other website as may be directed by Us (the “Effective Date“).

1.3. By registering or continuing to operate with You program and/or perform the activities under the Terms and Conditions, following the Effective Date, You agree to be bound by the UK Terms and all guidelines and/or policies provided to you by the Group from time to time. If You do not accept these UK Terms, You shall immediately cease any activity subject to the Terms and Conditions and You shall deliver a notice of termination in accordance clause 6.2 of the Terms and Conditions.

1.4. Any capitalised terms used which are not defined herein shall have the same meaning ascribed to them in the Terms and Conditions. In case of conflict or inconsistency between the Terms and Conditions and these UK Terms, these UK Terms shall prevail.

1.5. Except as expressly supplemented and/or amended by these UK Terms, the Terms and Conditions shall remain unchanged and in full force and effect and shall apply in respect of the UK market.

2. Limitations on Advertising

2.1. In addition to the terms included in clause 4.15 of the Agreement, the following terms shall be applicable to the UK market:

2.1.1. The following shall be prohibited:

a) Free-to-play versions of real money games visible and/or accessible without the necessary accompanying age verification of users on Your Affiliate Websites or any other websites you own or operate in the UK market. This limitation on advertising is applicable only to Your operations within the UK. For avoidance of doubt, this requirement does not apply to other forms of advertising such as screenshots or videos of games which might be available on Your Affiliate Websites, as long as these do not allow interaction by the customer;

b) advertising disseminated in places of medical and psychological care; intended for all levels of education; and others intended for attendance by people under the age of 18;

c) advertising that does not contain an age restriction notice, embodied in the "18+" symbol or the warning "not for persons under 18 years of age"; and

d) advertising or publicity for fixed-odds betting that involves the participation of minors or people that appear under 21 years of age; or that is directed towards children or adolescents (or those who have this target or majority audience), including, but not limited to, appeal to/target minors or vulnerable persons in any way.

2.1.2. Social Responsibility in Advertising

a) All marketing produced, placed, or facilitated by You shall comply with the applicable rules and guidance stated in Clause 4.6.1.2 in the Agreement, including but not limited to:

i. you shall not produce, place, or permit any marketing content for Our brands that is of strong appeal to children or young persons, whether or not that content is also appealing to adults, and whether or not it is placed in age-restricted media. This includes, without limitation, content featuring: cartoon-style or child-appealing characters, imagery, or animation; celebrities or social media personalities with a significant under-18 following; video game or esports references, styles, or crossovers with particular appeal to a young audience; and themes, humour, or language associated with youth culture;

ii. all marketing produced or placed by You shall be honest, accurate, and not misleading, including in respect of any claims relating to odds, returns, RTP, bonus value, or the likelihood of winning; and

iii. no advertising or other marketing information, whether relating to specific offers or to gambling generally, appears on any primary web page/screen, or micro site that provides advice or information on responsible gambling.

2.1.3. Promotional Terms

a) Where You advertise any bonus, free bet, or promotional offer, the significant terms (including wagering requirements, expiry, and any game or product restrictions) must be presented clearly and prominently alongside the offer itself, and not relegated to secondary or hard-to-find terms.

2.1.4. Age-Restricted Placement

a) You shall not place, or permit the placement of, any advertising for Our brands in media, on platforms, or in placements where the audience is not reasonably expected to comprise at least 25% persons aged 18 or over, and shall provide audience composition data to Us on request.

2.1.5. Safer Gambling Messaging

a) You shall display all safer gambling logos, messaging, and links specified by Us (including references to GAMSTOP and/or approved support organisations) in the format and prominence required by Us, and shall not remove, obscure, or alter such messaging.

2.1.6. Recognisability of Marketing Content

a) You shall ensure that all marketing communications are obviously identifiable as such, including clear disclosure (e.g. "#ad" or equivalent) of any sponsored, affiliate, or paid content, in accordance with CAP Code requirements on the recognition of marketing communications.

2.1.7. Substantiation of Claims

a) Any specific claims made by You regarding odds, returns, RTP, bonus value, or comparative pricing must be accurate as at the date of publication and capable of substantiation, with supporting evidence provided to Us on request.

2.1.8. No Cross-Sell or Mixed-Product Incentive Campaigns

a) You shall not create, run, or promote any advertising, offer, or incentive that encourages a customer to move from one gambling product to a different gambling product operated under Our brand(s) (e.g. "switch from sports betting to casino," multi-product welcome offers, or cross-product loyalty incentives), unless the specific campaign has been reviewed and approved in advance in writing by Us.

2.1.9. Wager Restrictions

a) You must not offer or advertise promotions which requires a customer to play through bonus funds, over a maximum of 10 times.

3. Our Rights and Remedies

3.1. In case of breach of the obligations set out in these UK Terms and/or your negligence in performing any marketing, Advertising, or promotional activities in accordance with the UK Terms, or failure to, in any way, meet your obligations hereunder, You shall be liable to Us in accordance with Clause 10 of the Terms and Conditions.
