Terms for Affiliates on Gambling Marketing and Advertising in Spain

1. Introduction
1.1. These are the Market-Specific Terms published by Us in respect of Spain for the purposes of clause 1.3 of the LeoVegas Affiliate Partner Terms and Conditions (the “Terms and Conditions”), and are referred to in this document as the “Spain Terms”. Together with the Terms and Conditions, the Spain Terms form a separate agreement for the Spanish market, in accordance with clause 1.3 of the Terms and Conditions, between GameTech Marketing Limited, a LeoVegas Mobile Gaming Group company, and You acting as an Affiliate.
1.2. These Spain Terms and any amendment to them, shall come into effect and become binding on You in accordance with clause 1.3.3 of the Terms and Conditions, including upon publication on https://www.leovegasaffiliates.com/terms-and-conditions, or any other website as may be directed by Us (the “Effective Date”).
1.3. By registering or continuing to operate with the affiliate program and/or perform the activities under the Terms and Conditions, following the Effective Date, You agree to be bound by the Spain Terms and all guidelines and/or policies provided to you by the Group from time to time. If You do not accept these Spain Terms, You shall immediately cease any activity subject to the Terms and Conditions and You shall deliver a notice of termination in accordance with clause 6.2 of the Terms and Conditions.
1.4. Any capitalised terms used which are not defined herein shall have the same meaning ascribed to them in the Terms and Conditions. In the event of any conflict or inconsistency between these Spain Terms and the Terms and Conditions, these Spain Terms shall prevail in respect of the Spanish market only.
1.5. Except as expressly supplemented and/or amended by these Spain Terms, the Terms and Conditions shall remain unchanged and in full force and effect and shall apply in respect of the Spanish market.
Additional Definitions
Significant Terms
Key restrictions and terms which apply to a promotion being advertised (being those likely to affect a
consumer’s understanding of the Promotion), including, but not limited to, if applicable:
- the amount of bonus;
- the minimum deposit necessary to get the bonus;
- wagering requirements;
- term available to withdraw the amount of the bonus; and
- all such other provisions which may be provided by Us to You from time to time.
DGOJ's Labelling Scheme
Standardised warning that shall be contained in all gambling advertisements within the market and shall feature responsible gaming logo and prohibition of players under the age of 18 in a black band in accordance with the guidance provided by Royal Decree 958/2020, of November 3, on commercial communications of gambling activities (https://www.boe.es/buscar/act.php?id=BOE-A-2020-13495).
2. Limitations on Advertising
2.1. In addition to the terms included in clause 4.15 of the Terms and Conditions, the following terms shall be applicable to the Spanish market:
a) events with underage persons cannot be advertised, e.g. “An event is mainly carried out by minors when the event is developed within the framework of a sport or other type of competition that, in a generalized way, only allows the participation of people of 18 of age, or under.”;
b) gambling advertising cannot use or include minors or celebrities under 25 years old and/or suggest that minors can gamble or place bets; and
c) Significant Terms and the DGOJ’s Labelling Scheme must be included in all applicable marketing communications, with the exception of online banners, micro-banners and radio adverts. With regard to marketing communications which do not require Significant Terms, the following shall apply:
i. Radio Adverts
- “Full Promotional Terms and Conditions Apply” shall be stated during the radio advertisement;
- “Logo +18” shall be vocally included; and
- “Juego seguro logo” shall be vocally included.
ii. Online banners & micro-banners
- The DGOJ’s Labelling Scheme shall be included in each banner type; and
- “Full Promotional Terms and Conditions Apply” shall be included in each banner type, with the aforementioned sentence being hyperlinked to the relevant Brand(s) promotional terms and conditions.
d) Gambling advertising cannot:
i. encourage antisocial, violent, discriminatory, or humiliating behavior;
ii. promote illegal gambling methods/types;
iii. cause financial, social, or emotional harm, or normalize addictive/compulsive gambling;
iv. glamorize repetitive, uncontrolled betting or high-emotion compulsive gaming;
v. suggest gambling should come before work, studies, or family/social relationships;
vi. show gambling in a workplace setting;
vii. present gambling as essential to life, or shame people who don't gamble (or glorify those who do);
viii. denounce abstinence from gambling;
ix. link gambling to improved skills, social status, sexual success, or attraction;
x. associate gambling with personal, professional, sporting, or family success;
xi. portray gambling as a solution to financial problems, an employment alternative, or an escape from personal/emotional struggles (loneliness, depression, etc.);
xii. suggest skill/experience removes the luck factor, or that repeated play improves odds;
xiii. give misleading win-probability information;
xiv. suggest losses are consequence-free, or that further gambling can recoup losses; or
xv. show active athletes (currently playing, or confirmed to return) participating in gambling.
3. Our Rights and Remedies
3.1. In case of breach of the obligations set out in these Spain Terms and/or your negligence in performing any marketing, Advertising, or promotional activities in accordance with the Spain Terms, or failure to, in any way, meet your obligations hereunder, You shall be liable to Us in accordance with Clause 10 of the Terms and Conditions.
